These Terms of Service ("Terms") form a legally binding agreement between you and HairMorph AI ("we", "us", or "our") covering your access to and use of our websites, applications, and related services (collectively, the "Services"). By creating an account, purchasing a plan or credits, or using the Services, you affirm that you have read, understood, and agree to these Terms.

Eligibility and Account Registration

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. When you create an account you agree to provide accurate, current information and to maintain the security of your credentials. You are responsible for all activity conducted under your account.

Our Services

HairMorph AI provides tools to generate and manage AI-powered hairstyle previews and related digital assets. The Services may include free trials, subscription plans, credit-based features, downloadable files, and customer support. We continually improve and update the Services; specific features may change, be limited, or discontinued with reasonable notice.

Platform Disclaimer

Important Notice: HairMorph AI is an independent platform that provides a user-friendly interface for AI-powered hairstyle transformations. We utilize various third-party AI models and technologies, including but not limited to OpenAI, Replicate, Fireworks, and fal.ai to power our hairstyle generation features.

HairMorph AI is not affiliated with, endorsed by, or officially connected to any of these AI model providers. All trademarks, service marks, and company names are the property of their respective owners. Our platform serves as a custom wrapper interface that makes these AI technologies more accessible for hairstyle preview purposes.

The quality and availability of our Services depend on the underlying AI models and their providers. We do not guarantee specific results and are not responsible for changes, limitations, or discontinuations made by third-party AI providers.

Merchant of Record and Payment Processing

Creem acts as the Merchant of Record and reseller for all paid transactions on HairMorph AI. By purchasing a subscription, credit package, lifetime plan, or any digital product, you agree that:

• Creem processes payments, collects and remits taxes where required, issues invoices, and appears on your payment statement.
• Creem may request information needed to validate your payment method, assess risk, comply with KYC/AML obligations, and prevent fraud. Failure to provide requested information may result in declined transactions or suspended access.
• Pricing is displayed in the checkout interface. Taxes, fees, and currency conversions are determined by Creem based on your billing details and applicable laws.

You authorize us and Creem to charge your selected payment method for recurring subscription fees until you cancel. Cancellation takes effect at the end of the current billing cycle unless otherwise stated. Access to paid features may end when a subscription expires or when credits are consumed.

Refund Policy

We strive to provide excellent service and customer satisfaction. Our refund policy is as follows:

Subscription Plans:

• You may request a refund within 7 days of your initial subscription purchase if you are not satisfied with the Services.
• Monthly subscriptions renewed after the initial period are non-refundable but can be cancelled at any time to prevent future charges.
• Annual subscriptions may be eligible for pro-rated refunds at our discretion if cancelled within 30 days of purchase.

Credit Packages:

• Unused credits are refundable within 7 days of purchase if no credits have been consumed.
• Once credits are used for generating hairstyle previews, the purchase becomes non-refundable.
• Credits that expire according to their terms are not eligible for refunds.

Response Time: We commit to responding to all refund requests within 3 business days. To request a refund or report any issues with your purchase, please contact us at wgq544520279wgq@gmail.com with your order details.

Processing: All refunds are processed through Creem as our Merchant of Record. Once approved, refunds typically appear in your account within 5-10 business days, depending on your payment provider. In case we do not respond to your refund request within 3 business days, Creem may process refunds according to their policies.

Credits, Generated Assets, and License

Credits represent the quantity of AI generation actions available to your account and may expire if not used within the timeframe stated during purchase. Generated images and outputs are licensed to you on a non-exclusive basis for personal or commercial use, subject to these Terms and applicable law. You are solely responsible for verifying that your use of generated content does not infringe any third-party rights or violate platform policies. We may retain copies of generated assets for product improvement, moderation, and compliance monitoring.

Acceptable Use

You agree not to:

• Misrepresent your identity, provide false testimonials, fabricate usage metrics, or otherwise engage in deceptive practices.
• Use the Services for unlawful, abusive, harmful, or high-risk purposes, including activities listed in Creem's prohibited product list.
• Upload content that infringes intellectual property rights, violates privacy or publicity rights, or contains malicious code.
• Attempt to access data or systems without authorization, interfere with the integrity or performance of the Services, or circumvent technical protections.

We may suspend or terminate access, disable content, or report activity to Creem or authorities if we suspect a breach of this section.

Intellectual Property

The Services, including all software, interfaces, templates, documentation, and branding, are owned by HairMorph AI or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no license or ownership interest is transferred to you.

Third-Party Services

We may provide integrations or links to third-party services (including Creem, authentication providers, or analytics tools). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services and your use of them is at your own risk.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any generated output will meet your expectations.

Limitation of Liability

To the maximum extent permitted by law, HairMorph AI and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for any claim will not exceed the greater of the amounts you paid for the Services in the six months preceding the claim or USD $100. Nothing in these Terms limits liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless HairMorph AI and our affiliates from any claims, losses, liabilities, damages, expenses, and costs (including reasonable attorneys' fees) arising from your breach of these Terms, your content, or your misuse of the Services.

Termination

You may stop using the Services at any time. We may suspend or terminate your access effective immediately if we believe you violated these Terms, applicable law, Creem's policies, or engaged in fraudulent or high-risk activity. Upon termination you remain responsible for outstanding payments and we may retain necessary information for legitimate business purposes.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which HairMorph AI is established, without regard to conflict-of-law principles. Any dispute arising from these Terms will be handled in that jurisdiction's courts unless applicable law requires otherwise.

Changes to These Terms

We may revise these Terms to reflect updates to our Services, legal obligations, or business needs. When we make material changes we will post the updated Terms with a revised effective date and, where required, provide additional notice. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.
